These Terms and Conditions apply to your use of gowebkart.in, to all services provided by Gowebkart Pvt. Ltd. (“Gowebkart”, “we”, “us”), including website design and development, web and mobile applications, graphic design, SEO, hosting and maintenance, and to the web applications we make and run ourselves, such as Gowebkart Campaigns (the “Applications”). By using our website, engaging our services, or creating an account in an Application, you agree to these terms. The sections “Gowebkart Applications” onwards apply to the Applications.
1.Services and Quotations
The exact work, deliverables, timeline and cost of each project are set out in the quotation or proposal we share with you. Work that is not listed there is outside the agreed scope and may be quoted separately.
Timelines are estimates and depend on you sharing content, feedback and approvals on time.
2.Payments
Payments are made in milestones, as listed in your quotation, for example at the start of the project, after design approval and before launch or final delivery.
Work begins once the first milestone payment is received.
Each following stage starts after the payment for the previous milestone is made.
Final files, website launch or handover of access happen after all dues are cleared.
Our prices and packages may change over time; the price in your accepted quotation applies to your project.
3.Cancellations and Refunds
If you cancel a project after work has started, 50% of the fees paid are non-refundable and the remaining 50% is refunded. Payments made to third parties on your behalf, such as hosting, domain, SSL, stock images or printing, cannot be refunded by us.
4.Your Responsibilities
Share accurate information, content and feedback on time.
Make sure you have the right to use any text, images, logos or other material you give us.
Review and approve designs and work at each stage; approved work may be charged if it has to be changed later.
Keep your own copies of important data and your account passwords safe.
5.Revisions
Designs include rounds of changes based on your feedback, as described in your quotation. Major changes to the approved scope, layout or features may be treated as new work and quoted separately.
6.Ownership of Work
Once all payments are made, you own the final designs, website content and code created specifically for your project, and for graphic work you receive the source files.
Third-party items such as themes, plugins, fonts, stock images and software libraries remain under their own licences.
Until full payment is received, the work remains the property of Gowebkart.
7.Hosting, Domains and SSL
When you ask us to, we arrange hosting, domain names and SSL certificates with third-party providers and set them up for you. These services are also subject to the providers’ own terms.
Renewal fees must be paid before the expiry date; services may stop if a renewal is missed.
We are not responsible for downtime, data loss or policy changes caused by the hosting or domain provider.
Regular backups are set up only when you request them.
8.Maintenance and Support
Support after launch and ongoing maintenance are provided as described in your quotation or maintenance plan. Changes made to your website by you or another party are outside our responsibility.
9.Confidentiality
We keep your business information, project details and access credentials confidential and use them only to deliver our services, as explained in our Privacy Policy.
10.Gowebkart Applications: Accounts
Gowebkart makes and runs its own web applications, such as Gowebkart Campaigns (email marketing). An Application is used on a subscription at its own address (for example campaigns.gowebkart.in), or bought and installed for you (see “Buying an Application”). These terms apply to both.
An account is created for a company by signing up in the Application or by Gowebkart on request. The person who signs up confirms that they are an adult, that the details given are true, and that they may act for that company. The first person becomes the company’s Super Admin and can add team members.
Each company has its own separate workspace. Your contacts, templates, campaigns, reports and settings are yours alone and are never shown to another company.
You are responsible for everything done through your company’s accounts, including by your team members and by programs using your API keys. Keep passwords and API keys secret, turn on two-step sign-in where offered, and tell us at once if you think an account has been misused.
Your company’s Super Admins manage its users, roles, permissions, settings, plan and payments.
11.Gowebkart Applications: Plans, Payments and Renewals
A new company starts on the Free plan, which has smaller limits and never ends. Paid plans (for example Starter, Growth and Pro) add bigger limits and more features. The current plans, their limits, features and prices are shown inside the Application on its Plans & Billing page, and on the Application’s page on gowebkart.in. A company in India pays in Indian rupees, with GST added where it applies and shown before you pay. A company outside India pays in US dollars, with no Indian GST (an export of services). The country is taken from the mobile number given at sign-up and can be corrected by Gowebkart on request.
A paid plan runs for one month, six months or one year from the day it starts. Six-month and yearly plans are billed for the whole period in advance, at the discount shown on the Plans & Billing page.
Payment is made by bank transfer or UPI to the details shown in the Application (from outside India: by PayPal, Wise or an international bank transfer to the details shown there), after which you submit the payment proof (screenshot and, if available, the transaction ID). The plan starts once we have confirmed the payment, and the invoice (PDF) is emailed to your Super Admins. A payment we cannot match is not applied, and we email you to sort it out.
Renewing the same plan before it ends adds the new period after the current one; you never lose days you have already paid for.
Upgrading (a bigger plan, more contacts, or a longer period) starts on the day the payment is confirmed. The unused part of the period you have already paid for is taken off the new price as a credit, worked out by days and shown in the Application and on the invoice. The credit can only be used against that upgrade; it is not paid out. When the credit is worth more than the new plan for the period chosen, choose a longer period so all of it is used.
Moving down to a smaller plan or a shorter period starts when the current paid period ends; until then you keep the plan you paid for.
Extra image storage can be added to a plan: on a paid plan it runs until the plan’s end date and is priced for the days left, and a bigger pack later costs only the difference for the days left. Image storage is the total space for your images, not a monthly allowance. When a pack ends, your images stay, but new uploads stop while you are above your space.
Plan fees are for the period you chose and are not refunded for unused time, except as an upgrade credit as described above, where the law requires it, or where we agree otherwise in writing.
When a paid plan ends and is not renewed, you can still sign in and see all your data, but sending and changes stop until you renew. Nothing is deleted because a plan ended.
Limits are counted as the Application shows them: contacts by the calendar month, emails by the calendar month and by the day, with a new day and month starting at midnight Indian Standard Time.
We may change plans and prices for the future. A change never shortens a period you have already paid for, and your Super Admins are emailed when something about your plan changes.
12.Gowebkart Applications: Sending Rules and Acceptable Use
Emails are sent through your own connected email accounts, in your name. You are the sender and are responsible for what you send and to whom. When you use an Application you agree to the following:
Send only to people who have agreed to hear from you, such as your customers, subscribers or people who signed up on your website. Bought, scraped or rented lists are not allowed.
Every marketing email must identify your business, show your real postal address where the law of the recipient’s country requires it, and carry a working unsubscribe link. The Application adds an unsubscribe link for you when your template has none; you may not remove or hide it.
People who unsubscribe, bounce or ask to be erased are placed on your suppression list and must not be emailed again from your accounts. The Application enforces this; you agree not to work around it.
You must follow the laws that apply to you and your recipients, including India’s Information Technology Act, 2000 and Digital Personal Data Protection Act, 2023, and, where you send abroad, laws such as CAN-SPAM (USA), PECR (UK) and the GDPR (EU), and the rules of your own email provider.
Not allowed in any email, template, form or file: spam or unsolicited bulk messages; phishing, fraud, malware or deceptive sender details; nude or sexual pictures, links to adult websites and sexually explicit text; anything that supports terrorism or explains how to make weapons; hate, harassment, illegal goods or services, or content that infringes someone else’s rights.
Content is checked automatically before it goes out. Content that fails the check is blocked or held for a review by Gowebkart, and your campaign waits until it is cleared or changed.
Sending limits protect everyone’s deliverability: your plan’s daily and monthly limits, each email account’s own daily limit and the warm-up of a newly connected account (a small amount on day one, doubling for a week). Sending pauses by itself when a campaign has far too many bounces or unsubscribes, and continues once the list is cleaned.
You must not try to break into, overload, copy, reverse-engineer or resell an Application, use it to host or send anything illegal, or use another company’s data.
If a company breaks these rules we may hold its campaigns, stop its sending, limit or suspend its account, or close it, depending on how serious the breach is. We tell the company’s Super Admins what was done and why. Serious abuse may be reported to the relevant authorities.
13.Gowebkart Applications: Your Data and Content
Everything you put into an Application, including your contacts, templates, images, files, campaigns and settings, stays yours. You give Gowebkart only the permission it needs to store, process, send and show that data in order to run the Application for you.
For the personal data of your contacts and recipients, your company decides why and how it is used (the data fiduciary / controller) and Gowebkart processes it on your instructions (the processor), as set out in our Privacy Policy. You confirm you have a lawful basis, usually consent, for every person you add. The Application records consent from sign-up forms and lets you export or erase a person on request.
Gowebkart keeps daily backups of the service and can restore them when something goes wrong. Items you delete wait in your Recycle Bin for 30 days and are then removed for good. Keep your own export of anything important; the Application lets you download contacts, reports and the activity log at any time.
Email account passwords, app passwords and API credentials you connect are stored encrypted and used only to send your email. You may disconnect an account at any time.
The open and click records of each campaign are kept for the number of months your plan includes; campaign totals are kept as long as the campaign exists.
Gowebkart’s staff do not open your data except to provide support you asked for, to check content held by the automatic content check, to investigate abuse or a security problem, or where the law requires it; such access is logged.
14.Gowebkart Applications: API Keys, Webhooks and Integrations
On plans that include them, API keys and webhooks let your own programs, website, shop or no-code tools read and write your company’s data. Anything done with your keys counts as done by your company.
Keys and webhook secrets must be kept confidential; you can revoke or rotate them at any time inside the Application. Requests above the published rate limits are refused, not queued.
Plugins and sample code Gowebkart provides (for example the WooCommerce plugin) are given free of charge, as they are, for use with the Application; you install and configure them on your own site.
Third-party services you connect, such as your email provider, your website platform, Zapier or Make, are governed by their own terms. Gowebkart is not responsible for them.
If your plan no longer includes API keys and webhooks, they stop working until the feature is back on your plan; nothing is deleted.
15.Gowebkart Applications: Availability, Support and Changes
We aim to keep the Applications available at all times, but they are provided “as is”, and short interruptions for maintenance, updates or problems at our hosting, network or your email provider can happen. Where we can, we announce planned maintenance in advance.
Whether an email reaches an inbox or a spam folder is decided by the receiving mail provider, not by Gowebkart. We do not guarantee delivery, open rates, clicks or sales.
Support is given by email to every plan, and by WhatsApp and a setup call on the plans that include them. The in-app Guide and the Knowledge Base on gowebkart.in are available to everyone.
We improve the Applications regularly and may add, change or remove features. We tell you in the Application or by email about changes that matter to how you work.
16.Gowebkart Applications: Closing an Account
You can stop using an Application at any time. Ask us to close your company’s account and we erase its data, after a short period in which you can still export it, unless the law requires us to keep something (for example invoices).
We may suspend or close an account that breaks these terms, has not been paid for, is used for spam or abuse, or puts other companies or the service at risk. Where it is reasonable to do so, we warn you first and give you a chance to fix the problem.
A Free account that has not been used for a long period may be closed after we have emailed its Super Admins and given them time to sign in or export.
17.Buying an Application
A company or an individual can also buy an Application outright instead of subscribing. In that case:
The scope, price, setup work, hosting arrangement, training and support period are set out in your quotation, and the Services sections of these terms (quotations, payments, refunds, hosting) apply.
We install and set up the Application for you and hand it over ready to use. When agreed in the quotation, you receive the source code.
You receive a licence to use, modify and run the Application for your own business, including to offer email campaigns as a service to your own clients. The licence does not allow you to sell, sublicense or publicly distribute the Application itself or its code as your own product.
Once it runs on your own server, you are responsible for its hosting, data, backups, sending rules and legal compliance. The “Sending Rules and Acceptable Use” section applies to how it is used.
Updates after the handover are provided as described in your quotation or maintenance plan.
18.Use of This Website
The content, logos, graphics and text on gowebkart.in belong to Gowebkart and are protected by copyright and trademark law. You may view and share our pages for personal and business reference, but you may not copy, republish or sell our content without written permission.
19.Limitation of Liability
We work carefully, but we cannot guarantee specific search rankings, sales, email delivery or uninterrupted service from third-party providers. To the extent allowed by law, our total liability for any claim related to a project is limited to the amount you paid us for that project, and for an Application to the plan fees you paid us in the twelve months before the claim. We are not liable for indirect losses such as lost profits, lost data you did not export, or penalties for emails you sent against the sending rules.
You agree to indemnify Gowebkart against claims from third parties that arise from content you sent, lists you used or laws you broke while using an Application.
20.Termination
Either party may end a project by written notice. Work completed up to that point is payable, and the Cancellations and Refunds section applies to payments already made.
21.Governing Law
These terms are governed by the laws of India. Any dispute will be subject to the jurisdiction of the courts at Delhi.
22.Changes and Contact
We may update these terms from time to time; the latest version will always be on this page, with the date it was last updated shown at the top. For changes that matter to Application users we also notify the company’s Super Admins in the Application or by email. For any question about these terms, contact us:
